Anna-Svidersky-2.jpg (300 × 225 pixels, file size: 39 KB, MIME type: image/jpeg)

Accessed from myspace.com June 24, 2006. Copyright presumed that of Anna Svidersky, now passed to her heir following her death.

Fair use rationale

This low resolution image is used in Anna Svidersky an article about the murder of this teenager and the subsequent worldwide "mourning effect" that occurred. This originated from her page of the myspace site, from where this image is taken. It is considered important that there should be a picture of Anna Svidersky for the proper understanding of the event and to inform readers of the article. There are no known free images available and it is now impossible for one to be taken. It is considered that this will not cause commercial harm to the original author. It is believed that this is fair use and does not infringe copyright.

According to section 107 of the United States Copyright Act of 1976:

The fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

The image is used for non-profit purposes. This factor is noted as relevant by the Act.

CopyrightedThis work is copyrighted (or assumed to be copyrighted) and unlicensed. It does not fall into one of the blanket acceptable non-free content categories listed at Misplaced Pages:Non-free content § Images or Misplaced Pages:Non-free content § Audio clips, and it is not covered by a more specific non-free content license listed at Category:Misplaced Pages non-free file copyright templates. However, it is believed that the use of this work:
  • To illustrate the subject in question
  • Where no free equivalent is available or could be created that would adequately give the same information
  • On the English-language Misplaced Pages, hosted on servers in the United States by the non-profit Wikimedia Foundation,

qualifies as fair use under United States copyright law. Any other uses of this image, on Misplaced Pages or elsewhere, may be copyright infringement. See Misplaced Pages:Non-free content and Misplaced Pages:Copyrights.
